Welcome to Kayalgram. By accessing or using our website (kayalgram.com) and/or booking any tours or services facilitated by us, you agree to be bound by these Terms & Conditions. If you do not agree to these Terms, please refrain from using our website or booking our services.

2. About Kayalgram

Kayalgram is a registered travel agency facilitating inbound tours in India, specialising in the western and southern regions (including Kerala, Tamil Nadu, Karnataka, Goa, Rajasthan, Delhi, and the western Himalayan side). We operate as an intermediary between travellers and service providers such as hotels, transport, guides, etc. We are not the direct supplier of all services listed.

3. Booking & Payment

3.1 All bookings made via our website or through our agents are subject to availability and confirmation.
3.2 To secure a booking, a deposit or full payment may be required as specified at the time of booking. Failure to pay by the due date may result in cancellation of your booking.
3.3 Final balance payments (if any) must be completed before the tour commences, unless otherwise agreed in writing.
3.4 Payment methods accepted will be as specified on our website. Any bank/transfer charges shall be borne by you.

4. Modifications & Cancellations by You

4.1 If you wish to modify or cancel your booking, you must submit your request in writing to Kayalgram.
4.2 Any modification or cancellation may incur charges as specified in your booking confirmation and according to the service providers’ policies.
4.3 No refunds will be made for unused services (e.g., if you skip part of the itinerary) unless agreed in writing.

5. Modifications & Cancellations by Kayalgram

5.1 We reserve the right to modify or cancel your tour prior to departure in circumstances such as insufficient bookings, force majeure, regulatory changes, or other causes beyond our control.
5.2 In such cases, we will offer either (a) a comparable alternative tour, or (b) a full refund of monies paid to Kayalgram (excluding any non-refundable third-party costs). Kayalgram will not be liable for additional costs incurred by you (e.g., travel, visas, personal arrangements).

6. Service Providers & Liability

6.1 Kayalgram acts as the agent arranging third-party services (accommodation, transport, guides, etc.). Each service is subject to the terms and conditions of the relevant supplier.
6.2 We endeavour to select reputable service providers; however, we cannot be held responsible for the failure or default of any supplier.
6.3 Our liability to you, whether in contract, tort (including negligence), or otherwise, shall be limited to the amount paid by you for the booking. We will not be liable for any consequential, indirect, special or punitive losses, including loss of enjoyment, loss of earnings, or personal expenses incurred.

7. Travel Documents & Visas

7.1 It is your responsibility to ensure that you possess valid travel documentation (passport, visas, permits, insurance) as required for your journey.
7.2 Kayalgram is not responsible for you being denied boarding or entry for any reason relating to travel documentation.

8. Health, Safety & Fitness

8.1 You must ensure you are medically and physically fit to travel and take part in the tour. Kayalgram may refuse a booking or ask you to withdraw if your participation could jeopardise the tour or other participants.
8.2 You are responsible for obtaining appropriate travel insurance covering cancellation, medical costs, and repatriation. Failure to obtain insurance is your responsibility.

9. Conduct & Behaviour

9.1 You are required to behave responsibly and respectfully throughout the tour, following the instructions of Kayalgram staff or our local partners.
9.2 If your behaviour is disruptive or dangerous, Kayalgram reserves the right to remove you from the tour and you will not be entitled to any refund.

10. Force Majeure

Neither you nor Kayalgram shall be liable for any default or delay caused by events beyond our reasonable control (“Force Majeure”) including, but not limited to, natural disasters, war, terrorism, civil unrest, pandemic, strikes, government regulation, or supplier insolvency.

11. Intellectual Property

All content, logos, images, materials on kayalgram.com are the intellectual property of Kayalgram or its licensors. You may not copy, reproduce or use them without our prior written permission.

12. Privacy & Data Protection

We collect and process your personal data in accordance with our Privacy Policy (linkable on the website). By booking with us or using the website, you consent to such processing.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising in connection with these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Kerala, India.

14. Changes to Terms & Conditions

Kayalgram reserves the right to revise or amend these Terms & Conditions at any time. The revised Terms will apply from the date they are posted on the website. It is your responsibility to review the Terms periodically.
